1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination. The respondents have filed Responses denying they have breached the Code.
2On February 19, 2014, the Applicant filed a Request for an Order during Proceedings seeking the production of numerous documents.
3The respondent, The Regional Municipality of Peel Police Services Board (the “Board”) opposes the Request for production on the basis that it is premature.
Decision
4Rule 16 of the Tribunal’s Rules provide for the disclosure of arguably relevant documents, which are required within 21 days of the issuance of a Notice of Hearing. The Tribunal will only require parties to engage in early production of documents in exceptional circumstances. There is nothing exceptional in these circumstances which justify early production of documents. I agree with the Board that the applicant’s Request for production is premature.
Order
5The Tribunal orders:
a. The applicant’s Request for production is denied as premature; and
b. The applicant must file Replies to the Responses within 14 days of the date of this Interim Decision.
6I am not seized.
