1This is an Application filed on May 24, 2013 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).

2This Application was deferred in 2013 HRTO 1328 issued on July 30, 2013 pending the conclusion of a grievance arbitration.

3The applicant has filed a Request for Order During Proceeding (“Request”) seeking the production of documents. The respondents oppose the Request.

4The Request is denied because this Application is deferred and therefore the Request is premature. Having come to this conclusion there is no need to deal with the other issues raised by the respondents.

5The Tribunal directs the parties’ attention to Rules 14.3 and 14.4 which outline the procedure by which the Application may be brought back on after the conclusion of the grievance process.
