1The hearing into this Application was originally scheduled to commence September 9, 2013, and was adjourned on consent of the parties.
2Since that time, the Tribunal has made a number of attempts to contact the applicant to reschedule the hearing. On September 5, 2013, an email was sent to the applicant requesting her available dates. On September 13, 2013, the Tribunal sent a letter to the applicant asking for a response by September 23, 2013. The Tribunal wrote again on January 14, 2014, asking for a response by January 31, 2014. The letter was sent by courier, email and mail. The couriered letter was returned; however, neither the email nor the letters were returned. Telephone messages were also left but not returned by the applicant.
3The Tribunal’s letters advised the applicant that failure to respond be considered an abandonment of the Application and it might be dismissed for that reason. The applicant has not replied to any of the Tribunal’s requests to set a new date for hearing and the time for doing so has now passed.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
