1This Application involves a number of allegations of discrimination arising out of the arrest of the applicant and subsequent proceedings. The Application indicated that there are ongoing proceedings under the Police Services Act. The Application indicated that as well there are proceedings before the courts related to the same issues described in the Application.

2When there are related proceedings underway, the Tribunal will usually defer consideration of an Application until the related proceedings have been concluded. In this case, the Tribunal issued a Notice of Intent to Defer on January 9, 2014, and invited submissions from the parties about whether the Application should be deferred. No submissions were received.

3Based on the available information, it appears that it is appropriate to defer further consideration of the Application until the other proceedings have concluded. Once the other proceedings have been concluded, the applicant may ask to have the Application re-activated. The Tribunal’s Rules provide that he must do so within six months of the conclusion of the other proceedings.
