1This Application was filed on July 9, 2013. The Application indicated that the applicant was represented by Don Menzies, a paralegal. The Application was delivered to the respondent. The respondent’s counsel contacted the Tribunal in September 2013. He advised that the applicant had been tragically killed in a motorcycle accident. He advised that he was in discussions with the applicant’s representative to determine if the applicant’s estate wished to pursue the Application.
2On November 19, 2013, the Registrar wrote to Mr. Menzies to say that the Tribunal needed to know whether the Application was going to proceed. The Registrar indicated that if necessary, a request to hold the Application in abeyance could be made. The Registrar stated that a response was required by December 11, 2013 and that the Application could be dismissed as abandoned if a response was not received by that date.
3To date no communication has been received in regard to the Application. It therefore appears that the Application is not being pursued and has been abandoned. The Application is dismissed as abandoned.
