Introduction
1By Application dated February 7, 2013, the applicant alleged that the respondents discriminated against her contrary to the Human Rights Code, R.S.O. 1990, c. H. 19, as amended (the "Code"). The Application is scheduled for a hearing March 17-19, 2014.
2Under Rule 1.7(p) of the Tribunal's Rules of Procedure, the Tribunal has the power to
require a party or other person to produce any document, information or thing and to provide such assistance as is reasonably necessary, including using any data storage, processing or retrieval device or system, to produce the information in any form.
3On January 22, 2014, the applicant filed a Request for an Order During Proceedings ("RFOP") in which she sought that her cell phone provider, Public Mobile, produce all telephone and text message records for her phone number [phone number redacted] for the period from August 1, 2010 to May 31, 2012 inclusive.
4The applicant indicated in her RFOP that the respondents agree that these records are arguably relevant and should be produced. The applicant also indicated that Public Mobile requires an Order from the Tribunal to produce the requested records.
ORDER
5Within 14 days of the date of this Interim Decision, Public Mobile is ordered to produce copies of all telephone and text message records for the applicant's phone number [phone number redacted] for the period from August 1, 2010 to May 31, 2012 inclusive.
