1This is an Application under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended, (the “Code”) alleging discrimination in employment on the basis of disability.
2The Tribunal scheduled a hearing for February 7, 2014 commencing at 9:30 a.m. at the Tribunal’s hearing centre in Toronto.
3The applicant was not present at the hearing. Where a party does not attend a scheduled hearing, the Tribunal may proceed in the party’s absence. In accordance with its usual practice, the Tribunal waited until 10:15 a.m. before proceeding. I informed the respondent that I would dismiss the matter as abandoned with a written decision to follow and I excused the respondent at 10:25 a.m.
4I am satisfied that the applicant had notice of the hearing. The Tribunal sent an amended Notice of Confirmation of Hearing dated November 12, 2013 to the applicant’s address listed in the Application and the document was not returned to the Tribunal.
5In view of the applicant’s non-attendance at the hearing, the Application is dismissed as abandoned.
ORDER
6For the foregoing reasons, the Application is dismissed as abandoned.
