1This is an Application alleging discrimination with respect to employment because of disability, contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"). The Tribunal scheduled a hearing in this matter for November 12, 2014 commencing at 9:30 a.m.
2The applicant did not attend the hearing. In accordance with its usual practice, the Tribunal waited until 10:00 a.m., at which I advised the respondent's representative that the Tribunal's usual practice in these circumstance is to dismiss the Application as abandoned. The respondent's representative agreed with that procedure. I am satisfied that the applicant had notice of the hearing. The Tribunal sent a Notice of Confirmation of Hearing (the "Notice") to the address the applicant has used in correspondence with the Tribunal and the document was not returned to the Tribunal. The Notice also contained the following warning to the parties:
FAILURE TO ATTEND THE HEARING
If you do not attend the hearing after receiving proper notice, the HRTO may proceed in your absence (if you are a respondent or intervener) or dismiss the Application as abandoned (if you are the applicant).
3In view of the applicant's non-attendance, the Application is hereby dismissed as abandoned.
