1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19 as amended, on March 24, 2014.
2On September 25, 2014, the Tribunal wrote to the parties requesting that they provide dates on which they were not available for a rescheduled summary hearing in October and November of 2014, by no later than October 2, 2014. The applicant did not respond to this request.
3The Tribunal sent a further letter to the applicant on October 9, 2014, by both regular mail and courier, requiring that he confirm his intentions with respect to the Application. The applicant was informed that if he wished to proceed with the Application, he must respond to the Tribunal’s earlier September 25, 2014 letter, as directed, and provide the Tribunal with agreeable dates for rescheduling the summary hearing. The applicant was advised that if he did not respond to the Tribunal’s correspondence by October 16, 2014, the Tribunal may deem the Application to be abandoned and close the file.
4To date, the applicant has not responded to the Tribunal’s correspondence referred to above. The Tribunal’s correspondence was sent to the applicant at the address provided in the Application and has not been returned as undeliverable.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
