1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2A hearing proceeded on June 25, 2014. Only the applicant and her counsel were in attendance.
3At the hearing, the applicant clarified that she had been advised that the respondent A.B.R. had filed for bankruptcy and that the other respondent, a corporation, was no longer in operation. The applicant requested that the Application be stayed in the case of A.B.R. and adjourned in the case of the corporate respondent so that the applicant could consider how she wished to proceed.
4On June 25, 2014, the Tribunal adjourned the Application and issued a number of directions including that the Application would be adjourned until September 26, 2014, and that on or before that date, the applicant would advise the Tribunal in writing of her intentions with respect to the Application.
5On October 3, 2014, the applicant emailed the Registrar indicating that the applicant does not intend to take steps to lift the stay in respect of A.B.R. and that she requests that the matter against K.C. be withdrawn.
6The Tribunal issued a Case Assessment Direction on November 5, 2014, which stated in part:
A copy of this Case Assessment Direction will be sent to the parties (to the respondents at their last known addresses). An objection by either of the respondents and/or the applicant to the foregoing shall be filed with the Tribunal by November 7, 2014. Absent receiving an objection from any of the parties, the Application will be withdrawn against K.C. and dismissed as abandoned against A.B.R. and the Tribunal’s file will be closed.
7No objection and/or any other communication has been received from any of the parties.
8In the result, the Application is withdrawn against K.C. and dismissed as abandoned against A.B.R. The Tribunal’s file will be closed.
