1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment because of family status and reprisal.
2On September 29, 2014, the applicant filed a Request for an Order During Proceedings seeking an order requiring the respondent to disclose the last name and last known contact information for a witness who is or was an employee of the respondent. The respondent did not file a Response to a Request for an Order and the time for doing so has passed.
3The applicant was employed as receptionist for the respondent. The applicant took parental leave after she and her spouse adopted a child. The applicant alleges that the respondent refused to accommodate her by adjusting her work schedule to meet her child care needs after she returned from leave. The applicant alleges that on or about July 19, 2013 a co-worker employed in the respondent’s lab named “Mike” informed the applicant that he had overheard the respondent’s Area Manager and Store Manager discussing means by which to punish the applicant after she returned from parental leave with a view to creating a situation that would allow them to terminate her employment. The applicant wishes to summons “Mike” to testify, but requires his last name and address to serve a summons on him.
Decision
4The witness identified by the applicant as “Mike” appears to have relevant evidence to give in this proceeding and I am satisfied that the applicant’s request should be granted.
Order
5The Tribunal orders as follows:
- Within 14 days of the date of this Interim Decision, the respondent shall disclose to the applicant the last name and last known address, telephone number and e-mail address of “Mike”, who is identified as an employee in the respondent’s lab in July 2013.
6I am not seized.
