Introduction
1A hearing in respect of this Application is scheduled for February 12, 13 and 14, 2014 in London.
2Upon review of the respondents’ witness statements, it appears that Luanne Dupon is being called to testify only to the fact that the respondent, Shoppers Drug Mart Inc., had no association with the applicant and that the respondent, Carolee Usborne Ltd., is licensed to use the trade name “Shoppers Drug Mart”.
3The applicant appears to acknowledge this in her Reply, requesting that the title of proceedings be amended to name the corporate respondent as “Carolee Usborne Ltd., carrying on business under the firm name and style of “Shoppers Drug Mart””.
4It appears to the Tribunal that Ms. Dupon will not be required to testify.
5Given that the hearing commences on February 12, 2014, unless the Tribunal receives a written objection by February 7, 2014, Shoppers Drug Mart Inc. is removed as a respondent, the style of cause will be amended and Ms. Dupon need not attend.
