1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code").
2In 2013 HRTO 637 issued on April 18, 2013 the Tribunal deferred this Application pending the conclusion of another proceeding.
3On July 22, 2014 the Tribunal wrote to the parties directing the applicant to inform the Registrar in writing before August 22, 2014 whether the other proceeding remained ongoing and, if possible, to indicate when it was expected to be completed. The letter went on to warn the applicant that failure to provide the requested information might result in the Tribunal dismissing the Application as abandoned.
4The applicant did not respond to the Tribunal's July 7, 2014 letter. The Tribunal's letter to the applicant was returned as undeliverable with the notation "moved" on the envelope. Other attempts by the Tribunal to reach the applicant by telephone were unsuccessful, one number being out of service and the other said to be the wrong number.
5In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
