1This Application was filed on the applicant’s behalf by his then representative Leonard Reece and concerned events at a Landlord and Tenant Board mediation session and complaints by Mr. Reece about that process to the Landlord and Tenant Board.

2On review of the Application, the Tribunal noted that it was not clear that Mr. Reece could represent the applicant because the Tribunal’s Rules provide that a representative must be someone who is recognized as able to represent a person in a legal proceeding under the rules of the Law Society of Upper Canada. It was also not clear that the Tribunal has jurisdiction to deal with the allegations and complaints set out in the Application.

3These issues were raised in a Notice of Intent to Dismiss and subsequently in Interim Decision 2013 HRTO 1946. Mr. Reece filed submissions on these issues on behalf of the applicant. Mr. Reese then advised the Tribunal that he was no longer representing the applicant. In a Case Assessment Direction dated December 19, 2013, I noted that the submissions from Mr. Reese had not resolved any of the concerns raised by the Tribunal about whether the Tribunal has the jurisdiction to deal with the issues raised in the Application. The applicant was invited to make submissions and was advised that if submissions were not received by January 16, 2014, the Tribunal might dismiss the Application as abandoned.

4To this date, no submissions have been received from the applicant. The Application is dismissed as abandoned.
