1This Application is scheduled for a hearing in Ottawa on October 6, 2014.
2The Tribunal issued a Case Assessment Direction (CAD) in this matter, stating as follows at paragraph 4:
The Tribunal directs that immediately, but in any event no later than September 19, 2014, the applicant must deliver to the respondent and file with the Tribunal the documents he intends to rely upon at the hearing, a list of his witnesses and a brief statement describing what his witnesses will say when they testify. If the applicant has not complied with this direction by September 19, 2014, the Application may be dismissed as abandoned.
3On September 22, 2014, the applicant sent an email advising the Tribunal that for mainly financial reasons, he would not be present at the hearing and he will accept a default judgment.
4In these circumstances, I find that the applicant has abandoned his Application.
ORDER
5The Application is dismissed as abandoned. The hearing scheduled for October 6, 2014 is cancelled.
