INTERIM DECISION
Adjudicator: Jo-Anne Pickel Date: September 24, 2014 Citation: 2014 HRTO 1422 Indexed as: Castiblanco v. Bee-Clean Building Maintenance
1This Interim Decision addresses the issue of whether the Applications filed by Andres Castiblanco, Luz Marina Carvajal-Parra and The Estate of Carolina Carvajal-Parra against Bee-Clean Building Maintenance and Lucy Macedo should be consolidated and heard together.
2All three Applications contain the same narrative and the respondents filed the same narrative in response to all three Applications. All three Applications proceeded to a joint mediation.
3By Case Assessment Direction (“CAD”) dated August 8, 2014, the Tribunal sought the parties’ positions on whether the Applications should be consolidated and heard together. It directed that the parties to advise the Tribunal of their positions on this issue in writing. None of the parties have replied to the Tribunal’s CAD and the time for doing so has now passed.
4I find that it is appropriate to consolidate these three Applications as they raise the same facts and legal issues.
