INTERIM DECISION
Adjudicator: Paul Aterman
Indexed as: McCauley v. IBM Canada Limited
WRITTEN SUBMISSIONS
IBM Canada Limited, Respondent
Andrew McCreary, Counsel
1This Interim Decision explains why an adjournment is being granted in this Application.
2A hearing is scheduled for September 23, 2014. On September 22, 2014, counsel for the respondent requested an adjournment because he has just become ill. Counsel for the applicant is aware of this and has not opposed the request.
3The unanticipated illness of counsel is an exceptional circumstance that justifies granting an adjournment in accordance with the Tribunal’s Practice Direction on Scheduling of Hearings and Mediations, Rescheduling Requests and Requests for Adjournments.
4Counsel jointly recommend that four consecutive days be set aside for the hearing of this Application. This seems to be a reasonable estimate of the time that will be needed to hear this Application and the Registrar is requested to reschedule the hearing accordingly.
