DECISION
Adjudicator: Brian Eyolfson
Decision Date: September 17, 2014
Indexed as: Holburn v. Kitchener Ford
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19 as amended, on May 5, 2014.
2On July 11, 2014, the Tribunal sent an email to the parties requesting that they provide mutually agreeable dates to reschedule a scheduled mediation, by July 18, 2014. The applicant did not respond to this request.
3On July 25, 2014, the Tribunal wrote to the applicant by both regular mail and email, indicating that the applicant had not responded to the Tribunal’s July 11, 2014 email concerning rescheduling. In its July 25, 2014 correspondence, the Tribunal directed the applicant to respond to its July 11, 2014 email regarding rescheduling if she wished to proceed with the Application. The Tribunal’s July 25, 2014 correspondence indicated that if the applicant did not respond by August 1, 2014, the Tribunal may deem the Application to be abandoned and close the file.
4To date, the applicant has not responded to the Tribunal’s above correspondence concerning rescheduling, and the Tribunal’s correspondence has not been returned as undeliverable.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
Dated at Toronto, this 17th day of September, 2014.
