1This is an Application under s.34 of the Human Rights Code, R.S.O. c.H.19, as amended (the "Code"). The hearing is scheduled for October 6, 2014.
2On May 7, 2014, the Tribunal issued a Notice of Confirmation of Hearing. The Notice directed the parties to take certain steps in advance of the hearing including, among other things, complying with Rules 16 and 17 of the Tribunal's Rules of Procedure by exchanging copies of their arguably relevant documents by May 28, 2014; and exchanging and filing with the Tribunal the documents they intended to rely upon at the hearing, a list of their witnesses and a summary of their witnesses' anticipated evidence by no later than August 22, 2014 (i.e. 45 days before the first scheduled day of hearing).
3The applicant did not do so.
4Accordingly, in a September 2, 2014 Case Assessment Direction, the Tribunal directed the applicant to provide the required materials by no later than September 10, 2014 failing which the Application may be dismissed by the Tribunal as abandoned.
5The September 10, 2014 deadline for complying with the Tribunal's directions has now passed and the applicant has not responded to or complied with it.
6In the circumstances, it appears that the applicant has abandoned the Application.
ORDER
7The Application is dismissed as abandoned. The October 6, 2014 hearing date is cancelled.
