Human Rights Tribunal of Ontario
BETWEEN:
Cheryl Langille Applicant
-and-
Bright Star Clinics and Tiffany Taseviski Respondents
DECISION
Adjudicator: David Muir Date: September 12, 2014 Citation: 2014 HRTO 1354 Indexed as: Langille v. Bright Star Clinics
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code").
2On September 23, 2013 the Tribunal deferred this Application without objection pending the conclusion of an ongoing proceeding at the Ministry of Labour.
3On July 17, 2014 the Tribunal wrote to the applicant directing her to inform the Registrar in writing before August 18, 2014 whether the other proceedings remained ongoing and, if possible, to indicate when they were expected to be completed. The letter went on to warn the applicant that failure to provide the requested information might result in the Tribunal dismissing the Application as abandoned.
4The applicant did not respond to the Tribunal's July 17, 2014 letter. The Tribunal's letter to the applicant has not been returned as undeliverable. The respondent did respond and indicated that settlement had been reached in the grievance arbitration.
5In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
Dated at Toronto this 12th day of September, 2014.
