1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code")

2In its Response (Form 2) the respondent requested that the Application be dismissed pursuant to section 45.1 of the Code because its substance had been appropriately dealt with in another legal proceeding. Alternatively the respondent sought the deferral of the Application pursuant to section 45 of the Code pending the conclusion of another proceeding.

3In correspondence dated June 3, 2014 the Tribunal delivered the Response to the applicant and directed that she file a Reply (Form 3) addressing the issues raised by the respondent. The applicant was further directed that if she did not file written submissions by the required date, the Tribunal would make its decision based only on the information in the Application and the Response or may consider the failure to file a Reply in these circumstances as an abandonment of your Application and dismiss the Application for that reason.

4The applicant did not respond to this Direction and the time for doing so passed.

5On August 14, 2014 the Tribunal wrote to the applicant reiterating the Directions above and directed that the applicant provide her Reply before August 28, 2014. The applicant did not respond to this Direction and the time for doing so has passed.

6The respondent filed a Request for Summary Hearing ("Request") on August 20, 2014 to which the applicant has not responded and the time for doing so has passed.

7The filing of an Application commences a legal proceeding which engages significant public and private resources. It is the Tribunal's expectation that the parties to an Application will participate in the process. This includes responding to issues raised by the other parties in the proceeding.

8In all of the circumstances I find that the applicant has abandoned this Application and it is dismissed.
