1This is an Application filed under section 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), alleging discrimination with respect to employment because of disability.

2The Application was deferred in an Interim Decision dated June 19, 2013 (2013 HRTO 1098) pending the conclusion of the criminal proceeding against the applicant. The criminal charges were laid several days before a hearing that was scheduled for March 6, 7, and 8, 2013.

3The applicant has filed a Request for Order During Proceedings ("RFOP") seeking to re-activate his Application. He provided a copy of a letter from his criminal counsel confirming that his criminal charges were withdrawn by the Crown.

4The respondents have not filed a Response to the RFOP and the time for doing so has elapsed.

5In these circumstances, the Tribunal finds that it is appropriate to re-activate the Application. Accordingly, the Tribunal will schedule the matter for a further 3 day hearing.
