1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), alleging discrimination with respect to employment because of sex. It will be heard on March 17 and 18, 2015 in Ottawa.
2In Interim Decision 2014 HRTO 989 dated July 7, 2014 the Tribunal denied the applicant's requests to change the venue of the hearing to Toronto, to have the Ontario Human Rights Commission monitor the Application and to have the member who conducted an attempt to mediate this Application assigned to conduct the hearing.
3On July 22, 2014 the applicant filed a request to have the Tribunal review the earlier requests she made. It is clear from this request that she disagrees with the Interim Decision 2014 HRTO 989 and wants the Tribunal to change that decision and grant the requests she made originally.
4In substance, if not in form, the applicant is asking for reconsideration of Interim Decision 2014 HRTO 989. It is well settled that the Tribunal's reconsideration process applies to final decisions (which are decisions that decide whether the Application itself will be allowed or dismissed) and not to interim decisions (which are decisions that deal with how an Application is processed up to the point that it gets to a hearing). The Tribunal's Practice Direction on Reconsideration (see: www.hrto.ca) explains that reconsideration applies only to final decisions.
5Because the Tribunal will not reconsider interim decisions, the applicant's request to review Interim Decision 2014 HRTO 989 is denied.
