1This This Application was filed on January 8, 2014, pursuant to s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), and alleges discrimination in employment.
2The respondent filed a Response to the Application on July 10, 2014, which included a request to dismiss the Application on the basis that another proceeding has appropriately dealt with the substance of the Application. On July 11, 2014, the Tribunal shared the respondent’s Response (Form 2) with the applicant, and directed the applicant to file a Reply (Form 3) to the respondent’s Response, including complete submissions in response to the respondent’s request to dismiss, by no later than July 25, 2014.
3In a Case Assessment Direction, dated July 31, 2014, the Tribunal noted that the applicant did not file a Reply as directed. Accordingly, the Tribunal directed the applicant to file a Reply to the respondent’s Response within 14 days of the date of the Case Assessment Direction. The Tribunal advised the applicant that if the applicant does not deliver and file a Reply within the time specified, the Tribunal may the Application as abandoned.
4As of the date of this Decision, the applicant has not filed a Reply. In the circumstances, the Tribunal deems the applicant to have abandoned the Application.
5The Application is dismissed.
