Human Rights Tribunal of Ontario
B E T W E E N:
Darryl Brochu Applicant
-and-
McDonald’s Respondent
DECISION
Adjudicator: Douglas Sanderson Date: August 25, 2014 Citation: 2014 HRTO 1255 Indexed as: Brochu v. McDonald’s
Introduction
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on April 22, 2014.
2On July 9, 2014 the Tribunal issued a Notice of Incomplete Application (the “Notice”) because the Application was not complete and could not be processed by the Tribunal at that time. The applicant was directed to answer the specific incomplete Application question(s) on the enclosed page(s), sign, and return the page(s) to the HRTO on or before July 29, 2014. The NOID advised the applicant that failure to provide an answer to the question(s) as directed would result in the Tribunal closing his file and returning his incomplete Application to him.
3August 5, 2014, the Tribunal issued a Failure to Respond to Notice of Incomplete Application Notice (the “Failure Notice”) because the applicant did not respond to the Notice of July 29, 2014. The Tribunal directed the applicant to provide the requested information as set out in the Notice by August 11, 2014. The Failure Notice advised the applicant that if the Tribunal did not receive the requested information by this date, his file would be closed and his incomplete application will be returned to him.
4The applicant has not responded to the Failure Notice and the time for doing so has now passed.
5In the circumstances, the Tribunal shall close its file and return the incomplete Application to the applicant.
Dated at Toronto, this 25^th^ day of August, 2014.
