Adjudicator: Brian Eyolfson
Date: August 19, 2014
Citation: 2014 HRTO 1233
Indexed as: Faubert v. National Grocers Co. Ltd.
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on February 24, 2014.
2On June 6, 2014 the Tribunal issued a Case Assessment Direction (“CAD”) directing the applicant to provide a Reply (Form 3) addressing the respondent’s request that the Application be dismissed on the basis that the applicant signed a full and final release in relation to the events described in the Application. The applicant was directed to file a Reply within 14 days of the date of the CAD, and was warned that if he failed to do so, the Tribunal might consider the Application to be abandoned and dismiss it on that basis.
3The applicant has not responded to the CAD and the time for doing so has now passed.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
Dated at Toronto, this 19th day of August, 2014.
