1This matter is scheduled for hearing in London on November 19, 2014.
2In accordance with the Notice of Hearing issued and with Rule 16 of the Tribunal’s Rules of Procedure, the parties were directed to exchange copies of all arguably relevant documents by June 13, 2014. The Notice of Hearing also indicates that the parties must file a Form 23 confirming that they have exchanged all arguably relevant documents.
3On July 21, 2014, the respondent filed a Request for an Order During Proceedings (the “RFOP”) seeking that the applicant comply with his obligations under the Rules and that he deliver all arguably relevant documents.
4The applicant has not filed a response to the respondent’s RFOP. Further, he has not confirmed with the Tribunal that he has delivered all arguably relevant documents as required in the Notice of Hearing.
5It is therefore appropriate to grant the respondent’s RFOP and order the applicant to comply with his obligations under the Rules.
Order
6The Tribunal orders:
a. Within 14 days of the date of this Interim Decision the applicant must deliver all arguably relevant documents to the respondent and/or confirm in writing that he does not have any arguably relevant documents; and
b. Within 14 days of this Interim Decision the applicant must confirm in writing to the respondent and the Tribunal that he intends to proceed with the Application and that he will be attending the scheduled hearing.
