1The complaint alleged discrimination because of disability contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), in the special diet allowance provided under Ontario’s social assistance system. In Interim Decision, 2014 HRTO 824, the applicant was directed to provide material and submissions by July 31, 2014, in support of his claim in relation to cardiovascular disease. The Interim Decision advised the complainant that if he did not provide these materials the claim would be dismissed as abandoned.
2The complainant has not filed any materials nor communicated with the Tribunal in any manner about the above claim. Therefore, his claim in relation to cardiovascular disease is dismissed as abandoned.
3In Interim Decision, 2014 HRTO 824, the Tribunal also directed the parties to advise the Tribunal as to the status of the complainant’s claim in relation to Hepatitis C. By letter dated July 29, 2014, the respondent advised that it added Chronic Hepatitis C (Body Mass Index < 25) to the special diet schedule in January 2013. The respondent advised that it has not received a special diet application from the complainant for this condition since February 2013. In these circumstances, the complainant’s claim with respect to Hepatitis C is dismissed as abandoned.
ORDER
4The complainant’s remaining claims in relation to cardiovascular disease and Hepatitis C are dismissed as abandoned.
