1In its Response, the respondent requested that the Tribunal dismiss part of the Application as untimely. In his Application filed on June 12, 2013, the applicant alleged discrimination in relation to two incidents: one that occurred on November 21, 2011 and the other on November 12, 2012. The respondent requested that the first incident be dismissed as untimely.
2The Tribunal already addressed the timeliness of the allegations in Interim Decision, 2014 HRTO 781. In that Interim Decision, I found that there was a sufficient thematic connection between the two incidents raised in the Application to consider both of them to be timely even if there was a fairly lengthy period of time that elapsed between them. In that Interim Decision, I also found that incidents which the applicant referred to in the summary hearing of this matter that allegedly occurred at various points over the last 17 years were untimely under the Code.
Order
3For the reasons set out above, the respondent’s request to dismiss part of the Application as untimely is dismissed. This issue has already been determined in Interim Decision, 2014 HRTO 781.
4Since both parties have agreed to mediation, the next step in this case will be for the Registrar to schedule a mediation.
