1The applicant filed two Applications under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on August 13, 2013, and October 17, 2013.
2Having reviewed the materials, the Tribunal issued a Case Assessment Direction on March 25, 2014 noting that it appeared some of the allegations may be untimely and also noting that the applicant may be unable to prove a link between the conduct of the respondents and grounds enumerated in the Code. It directed a summary hearing to determine whether all or parts of the Applications should be dismissed because all or parts of them have no reasonable prospect of success.
3On April 10, 2014, the Tribunal issued a Notice of Joint Summary Hearing to the parties confirming that a summary hearing of the Applications would take place on July 10, 2014, commencing at 1:30 p.m. by teleconference, and providing instructions on how to connect to the teleconference hearing. The Notice was delivered to the applicant at the only address provided by the applicant to the Tribunal and was not returned as undeliverable.
4I am satisfied that the applicant had notice of the hearing.
5The applicant was not in attendance at the commencement of the scheduled hearing. In accordance with its usual practice, the Tribunal waited half an hour before proceeding.
6At 2:00 p.m. the applicant was still not in attendance nor had the applicant communicated with the Tribunal to explain the failure to attend.
7In the circumstances, the Applications are dismissed on the basis that the applicant is deemed to have abandoned the Applications.
