1This Application alleges discrimination with respect to employment because of disability contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2In an Interim Decision, 2013 HRTO 1081, the Tribunal deferred the application pending the conclusion of the grievance process.
3The applicant has filed a Request for Order During Proceedings (“RFOP”) seeking to re-activate his deferred Application because he has been advised by his union that his grievance file has closed. The Tribunal has written to the applicant requesting that he provide the date that the union informed him of this, but the applicant has advised that he has not been able to obtain this information.
4The respondent filed a Response to the RFOP and does not oppose the applicant’s Request.
5In these circumstances, the applicant’s request to re-activate is granted. Since the parties have agreed to mediation, the Tribunal will schedule a mediation date. The parties will be advised of the mediation date under separate cover.
6I am not seized with this matter.
