Link-On Communications Inc. Respondent
DECISION
Adjudicator: David Muir Date: July 18, 2014 Citation: 2014 HRTO 1055 Indexed as: Thistle v. Link-On Communications Inc.
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on March 14, 2014.
2In its Response (Form 2) filed on May 14, 2014 the respondent requested that the Application be dismissed because it was outside of the Tribunal’s Direction to decide being integral to a federal work or undertaking and therefor within Federal jurisdiction.
3On June 19, 2014 the Tribunal delivered the Response to the Application. The applicant was directed to provide his written submissions in response to respondent’s request the before July 3, 2014. The applicant was further advised that if he did not provide written submissions by the required time the Tribunal may make its decision based only on the information in the Application or may consider the failure to respond as an abandonment of the Application and dismiss it for that reason.
4The applicant did not respond to the Tribunal’s Directions above and the time for doing so passed.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
Dated at Toronto, this 18th day of July, 2014.
