1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on December 31, 2013.
2On April 8, 2014 the Tribunal issued a Notice of Mediation to the parties confirming that mediation of the Application would take place on May 13, 2014.
3On May 2, 2014, the applicant advised the Tribunal that she would not be able to attend the scheduled mediation session. By correspondence to the parties dated May 9, 2013, the mediation scheduled for May 13, 2014 was cancelled. The applicant was also asked to email the Tribunal, and copy the respondent, by May 13, 2014 to confirm if she wished to proceed with the Application. The Tribunal did not hear from the applicant by May 13, 2014.
4On May 14, 2014 the Tribunal wrote to the applicant directing that the applicant advise the Tribunal and the respondent of her intentions with respect to the Application. The Tribunal’s letter warned the applicant that if she did not respond to the letter in writing by May 26, 2014, the Tribunal may deem the Application to be abandoned and dismiss it on that basis.
5As of the date of this Decision the applicant has not responded to the Tribunal’s May 14, 2014 letter. The letter was sent to the applicant by both regular mail and email at the addresses the applicant provided in the Application, and has not been returned as undeliverable.
6In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
