1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended.
2On February 6, 2014 the Tribunal issued a Case Assessment Direction which directed that a Summary Hearing would be convened to address a number of preliminary issues. On March 14, 2014, the Tribunal issued a Notice of Summary Hearing which scheduled the Summary hearing on July 15, 2014, at 9:30 a.m. via telephone conference.
3The Case Assessment Direction and the Notice of Summary Hearing were sent to the address provided on the Application by the applicant and these two documents were returned to the Tribunal as undeliverable.
4On March 26, 2014, the Tribunal forwarded the Case Assessment Direction and the Notice of Summary Hearing to the email address provided by the applicant and asked the applicant to immediately provide the Tribunal and the respondent with his new contact information.
5On July 2, 2014, the Tribunal issued a Case Assessment Direction which reminded the applicant that pursuant to Rule 1.13: “A party must notify the Tribunal and all parties and their representatives, in writing, of any change in their contact information, as soon as possible.”
6In this Case Assessment Direction the Tribunal directed the applicant, by no later than July 10, 2014, to confirm in writing to the Tribunal and the respondent:
a. His new contact information; and
b. That he was proceeding with the Application and that he would participate via telephone conference in the Summary Hearing scheduled on July 15, 2014.
7The Tribunal advised the applicant that if he failed to comply with the directions in this Case Assessment Direction then the Application could be dismissed as abandoned.
8As of this date the applicant has not responded to any of the Tribunal’s correspondence or directions.
9In the circumstances, the applicant is deemed to have abandoned the Application.
10The Application is dismissed and the Summary Hearing is cancelled.
