1In an earlier Interim Decision in these matters, 2013 HRTO 636, the Tribunal ordered the consolidation of Applications 2012-12867-I and 2012-13120. The Tribunal also directed the applicants to file submissions regarding whether 2012-12819-I should be consolidated with Applications 2012-12867-I and 2012-13120, as requested by the respondent. Finally, the Tribunal directed all parties to file submissions regarding whether all three Applications should be mediated together and noted that Application 2012-12819-I is currently scheduled for mediation on June 18, 2013.
2On April 30, 2013, Ms. Buckmaster filed submissions indicating her consent to mediate the three Applications jointly. On May 3, 2013, Ms. Tarczy filed submissions indicating that she did not oppose consolidating Application 2012-12819-I with her Application, 2012-12867-I. Also on May 3, 2013, the respondent filed submissions indicating that it does not oppose proceeding by way of joint mediation and proposed that the matters proceed to joint mediation on June 18, 2013, the date on which mediation is scheduled for Application 2012-12819-I. Mr. Johnson did not file submissions and the time allocated for doing so has passed.
3Rule 1.7 d) provides that in order to provide for the fair, just and expeditious resolution of any matter before it the Tribunal may consolidate or hear Applications together.
4In this case, having regard to the material filed and submissions made, I am satisfied that there is a strong public interest in consolidating these Applications. The Tribunal shall therefore consolidate Applications 2012-12867-I, 2012-13120 and 2012-12819-I. The Tribunal shall also schedule all three Applications for a joint mediation session on June 18, 2013.
Order
5The Tribunal orders as follows:
Applications 2012-12867-I, 2012-13120 and 2012-12819-I are consolidated; and,
The Tribunal shall schedule all three Applications for a joint mediation session on June 18, 2013 in St. Catharines.
6I am not seized of this matter.
