1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), alleging discrimination with respect to employment because of disability.
2By Notice of Confirmation of Hearing dated November 23, 2012, the Application was set down for a hearing on June 10 and 11, 2013. The Notice of Confirmation of Hearing directed the parties to comply with Rules 16 and 17 of the Tribunal’s Rules of Procedure by exchanging with one another and filing with the Tribunal the documents they intend to rely on at the hearing, a list of their witnesses and a summary of their witnesses’ anticipated evidence no later than April 26, 2013. The respondents complied with Rules 16 and 17 but the applicant did not.
3By Case Assessment Direction (CAD) dated May 3, 2013, the Tribunal directed the applicant to provide the required hearing materials immediately. The applicant was advised that if she did not do so within seven days of the CAD then the Application may be dismissed as abandoned.
4There is no indication that the applicant has not received the Notice of Confirmation of Hearing and the CAD. No mail or e-mail has been returned as undeliverable. I am satisfied that the applicant has received notice of the impending hearing and the CAD dated May 3, 2013.
5As of the date of this Decision, the applicant has not filed the materials as required or contacted the Tribunal to explain her failure to comply with the direction set out in the CAD. In the circumstances, it appears that the applicant does not intend to proceed with the Application. Accordingly, the Application is dismissed as abandoned.
ORDER
6The Application is dismissed as abandoned and the hearing dates of June 10 and 11, 2013 are cancelled.
