1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2A summary hearing to determine whether the Application has any reasonable prospect of success is scheduled to take place on May 21, 2013, by way of teleconference.
3On April 29, 2013 the applicant requested that the summary hearing be adjourned because his spouse is undergoing medical treatment for a life-threatening illness. The respondent objects to the request.
4According to the Tribunal’s “Practice Direction on Scheduling of Hearings and Mediations, Rescheduling Requests, and Requests for Adjournments”, requests for adjournments made outside the ordinary time limit for rescheduling requests, as this one is, will only be granted in extraordinary circumstances.
5Given the seriousness of the illness of the applicant’s spouse and the nature of her treatment, I am satisfied that extraordinary circumstances exist that justify the adjournment of the summary hearing.
DECISION
6The Tribunal makes the following orders:
a. The summary hearing scheduled for May 21, 2013 is adjourned.
b. The parties shall provide their available dates for the months of July and August, 2013 to the Registrar by May 21, 2013
