INTERIM DECISION
Adjudicator: Ena Chadha Date: April 26, 2013 Citation: 2013 HRTO 709 Indexed as: Tranchemontagne v. C.J. Morris Investments Ltd. o/a Sudbury Hyundai
WRITTEN SUBMISSIONS
Michael Tranchemontagne, Applicant: Self-represented
1The applicant filed this Application under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, alleging discrimination with respect to employment because of disability and reprisal.
2This Application was deferred by Interim Decision 2012 HRTO 2322 pending the completion of proceedings before the Workplace Safety and Insurance Board (“WSIB”) and the conclusion of any appeals.
3On March 5, 2013, the applicant applied for reactivation and provided a copy of the WSIB Appeals Resolution Officer Decision, dated January 7, 2013. The applicant submits that he wishes for the Application to now continue because the WSIB appeal was denied and that he has no intention to further appeal the matter.
4The respondent did not file submissions with respect to the issue of reactivation.
5Given that the WSIB proceedings are completed and that the respondent has taken no position with respect to the applicant’s request, the Tribunal determines that it is appropriate to reactivate this Application.
6Accordingly, the Application will continue in the Tribunal process.
7I am not seized of this matter.
Dated at Toronto, this 26th day of April, 2013.
