1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to services. The Tribunal is in the process of hearing this Application.
2During the course of the first day of hearing, the Tribunal was advised that there exists a recording, in either a video or audio format, with respect to the applicant’s arrest on January 26, 2010 (the “recording”).
3On April 11, 2012, the Tribunal issued an Interim Decision, 2013 HRTO 602, which ordered the applicant to provide a copy of the recording to the respondents or written submissions from his counsel if he opposes to the production of this recording by no later than 9:00 a.m. April 12, 2013. The applicant was unable to comply with this time-limit and the Tribunal has granted an extension of this time limit.
4The Tribunal Orders the applicant by no later than April 19, 2013 to:
a. Provide a copy to the respondents’ counsel and the Tribunal of the recording; or
b. If the applicant’s counsel opposes the production of this recording than he must file written submissions explaining his opposition to the Tribunal, with a copy to the respondents, by no later April 19, 2013.
