1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment because of ethnic origin, place of origin, race and reprisal.
2A mediation was scheduled to take place in this case on July 25, 2012, but the applicant did not attend. The applicant was directed by the Tribunal to indicate her intentions with respect to this case. On August 7, 2012, the applicant indicated that she wished to continue mediation with the respondent. A hearing date was scheduled to take place on April 2, 2013.
3On November 27, 2012, the respondent filed a Request for Summary Hearing (Form 26). The applicant did respond to this Request.
4In a Case Assessment Direction issued to the parties on December 20, 2012, the applicant was directed to deliver and file a Response (Form 11) to the Request of the respondent together with an explanation for her failure to provide her Response in a timely manner, within 14 days of the date of the Direction failing which this Application may be dismissed as abandoned
5As of this writing the applicant has not responded to the Tribunal’s Directions above in any way and has not made any contact with the Tribunal. I find that the applicant has abandoned this Application and accordingly it is dismissed.
