1This is an Application filed on November 23, 2012 under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2On February 1, 2013 the Tribunal issued a Notice of Intent to Dismiss (“NOID”) on the basis that it appeared that the Application was outside the Tribunal’s jurisdiction. The applicant was directed to respond to the issues raised in the NOID by no later than March 4, 2013. The NOID advised the applicant that failure to respond to the NOID may be considered an abandonment of the Application and it might be dismissed for that reason. The applicant has not responded to the request for submissions in respect of the NOID and the time for doing so has now passed.
3In the circumstances, the applicant is deemed to have abandoned the Application.
4The Application is dismissed pursuant to Rule 5.4 of the Rules of Practice and the file is closed.
