DECISION
Adjudicator: David Muir
Indexed as: Neufeld v. Dundas Dental Care
1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment because of reprisal.
2On January 28, 2013 the Tribunal issued a Notice of Intent to Dismiss this Application because it appeared to be outside of the Tribunal’s jurisdiction because the applicant made no connection between the incidents complained of and the reprisal provision of the Code.
3The applicant was directed to file her submissions in response to the NOID on or before February 26, 2013 failing which the Tribunal would determine its jurisdiction to deal with it based on the material filed to date or, may dismiss the Application as abandoned.
4The applicant has not responded to this Application in any manner whatsoever and appears to have abandoned it. The Application is accordingly dismissed as abandoned.
Dated at Toronto, this 15th day of March, 2013.
