DECISION
Adjudicator: Naomi Overend Date: March 14, 2013 Citation: 2013 HRTO 442 Indexed as: Bradley v. Corporation of the City of Sarnia
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on June 26, 2012.
2The respondent filed its Response to the Application dated November 15, 2012.
3By letter dated January 11, 2013, the Tribunal delivered the respondent’s Response and Notice of Request to Dismiss the Application to the applicant. The applicant was directed to file a Reply to the Response, including complete written submissions in response to the respondent’s Request to Dismiss by no later than January 25, 2013. The applicant was further advised that failure to file written submissions and a Reply to the Response by the required date of January 25, 2013 may be considered an abandonment of the Application and it might be dismissed for that reason.
4The applicant has not filed written submissions or a Reply to the Response by the required date of January 25, 2013 and the time for doing so has now passed.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
