1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). The Application has not been served on the respondent.
2On January 25, 2013, the Tribunal issued to the applicant a Notice of Intent to Dismiss (“NOID”) the Application on the basis that it did not appear that the Application was within the Tribunal’s jurisdiction. The NOID directed the applicant to provide written submissions by no later than February 25, 2013, to explain why the Application was within the jurisdiction of the Tribunal. The NOID states that if the applicant failed to provide written submissions as directed that the Application could be dismissed as abandoned.
3I am satisfied that the NOID was sent to the applicant and that the applicant did not file written submissions as directed and the time for doing so has passed.
4In these circumstances the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
