Introduction
1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code").
2On January 31, 2013, the Registrar issued a Notice of Intent to Dismiss ("NOID") that stated that it was the Tribunal's intention to dismiss the Application, based on lack of jurisdiction, because the Application did not set out any specific incidents of alleged discrimination that were related to a Code.
3On February 25, 2013, the applicant, in response to the NOID, made submissions in which she alleges, amongst other things, discrimination and harassment on the basis of sex. Having reviewed these materials it is therefore, not plain and obvious that the Application falls outside the Tribunal's jurisdiction and I decline to dismiss it at this stage. This is not a final decision in respect of the Tribunal's jurisdiction over this matter.
4As provided for in Rule 13.5, the Application and the materials in the Tribunal's file will now be delivered to the respondents, together with a Notice of Application requiring a Response within 35 days.
5I am not seized.
