1This Application was filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment because of ancestry.
2This Application was filed on July 4, 2012, following which the Tribunal made several attempts to communicate with the applicant to confirm his contact information and, in particular, a mailing address.
3On December 4, 2012, the Tribunal issued a Case Assessment Direction requiring the applicant to confirm in writing his intention regarding whether or not he wished to proceed with this Application.
4On December 9, 2012, the applicant wrote to the Tribunal and provided further details of his allegations.
5On December 17, 2012, the Tribunal wrote to the applicant asking for confirmation of his mailing address. The applicant did not reply to this correspondence. On January 3, 2012, the Tribunal again wrote to the applicant requesting that he confirm his address no later than January 8, 2013. The applicant did not respond to this correspondence.
6On February 5, 2013, the Tribunal issued a Case Assessment Direction requiring the applicant to provide the following information:
i. His Postal Mailing Address, including any unit number and postal code
ii. His Email Address
iii. His Daytime Phone Number
iv. His Cell Phone Number
7The Case Assessment Direction expressly stated that if the applicant failed to comply with the above-noted directions, the Tribunal would dismiss the Application as abandoned.
8The applicant has not corresponded or communicated with the Tribunal in accordance with any of the foregoing directions.
9In these circumstances, the Application is dismissed as abandoned.
