Introduction
1This is an Application filed on November 30, 2012 under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), alleging discrimination with respect to employment because of sex, specifically sexual harassment. The respondents have filed a joint Response denying the allegations.
2The applicant filed a Request for Order During Proceedings ("RFOP"), dated January 19, 2013, in which she requested that the Tribunal permit her to amend the remedies claimed in her Application to include an unspecified financial remedy. She also requested an extension of time to seek legal advice or assistance before filing her Reply. Subsequent to filing her RFOP, the applicant emailed the Tribunal, copying the respondents' counsel, requesting an extension within which to file her Reply, which was granted by the Tribunal. The applicant has now filed a Reply. The respondents have not responded to the RFOP and the time for doing so has elapsed. The applicant has not communicated further with the Tribunal to identify what specific financial remedy she is seeking from the respondent(s).
3In these circumstances, and at this time, the applicant's RFOP to amend her Application to include a financial remedy is denied. The applicant has not identified what specific financial remedy she is seeking to include in her Application and in the absence of this information, the Tribunal will not permit her to amend her Application.
4In the event that the applicant files another RFOP specifying this information, then this second RFOP, and any Response to the RFOP filed by the respondents, will be considered by the Tribunal.
