1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to the provision of services on the basis of race, ancestry, place of origin, ethnic origin and creed.
2The Application was scheduled to be heard on February 25, 2013. On January 30, 2013, the applicant wrote to the Tribunal to indicate that he was having trouble confirming his travel from Iran back to Canada with the airline that issued his ticket and was not certain as to whether he would be able to return for his scheduled hearing.
3On February 4, 2013, the Tribunal issued a Case Assessment Direction (“CAD”) directing the applicant to confirm within 7 days whether he would be returning for his hearing. The CAD indicated that if the applicant did not respond to its directions or indicated that he would not be attending his hearing the Tribunal may dismiss his Application as abandoned. The CAD also indicated that if the applicant was not returning to Canada it was open to him to request that his hearing be adjourned. The CAD further noted that the Tribunal only grants adjournments in exceptional circumstances.
4On February 6, 2012, the applicant emailed the Tribunal to state that he was continuing to have difficulties resolving his airline ticket and that it would be too costly for him to return to Canada in time for his scheduled hearing. He also stated that he did not see returning to Canada in the foreseeable future. The applicant asked that the Tribunal dismiss his Application.
5Given that the applicant will be unable to return for his scheduled hearing and has asked that his Application be dismissed the Tribunal dismisses the Application as abandoned.
6The applicant also requests in his email that the respondent take his name off their black list. This is not a request that the Tribunal can address.
