Human Rights Tribunal of Ontario
B E T W E E N:
Robert Makos Applicant
-and-
Toronto Public Library Respondent
DECISION
Adjudicator: David Muir Date: December 24, 2013 Citation: 2013 HRTO 2117 Indexed as: Makos v. Toronto Public Library
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on October 7, 2013.
2On November 4, 2013 the Tribunal issued a Notice of Intent to Dismiss the Application (“NOID”) on the basis that the Application appears to be outside the Tribunal’s power to decide. The applicant was directed to respond to the issues raised in the NOID by no later than December 4, 2013. The NOID advised the applicant that failure to respond to the NOID may be considered an abandonment of the Application and it might be dismissed for that reason.
3The applicant did not responded to the NOID and the time for doing so passed. On December 9, 2013 the Tribunal further directed that the applicant respond to the issues raised in the NOID before December 13, 2013. As of this writing the applicant has not responded to the NOID or communicated with the Tribunal in any manner.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
Dated at Toronto, this 24th day of December, 2013.
