1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment, housing and goods and services because of gender identity, sex, sexual solicitation and reprisal.
2The Application was filed with the Tribunal on March 21, 2013.
3On November 1, 2013, the Tribunal issued a Notice of Intent to Dismiss (“NOID”). The NOID advised the applicant that the Application may be outside of the Tribunal’s jurisdiction because “A review of the Application and the narrative setting out the incidents of alleged discrimination fails to identify any specific acts of discrimination within the meaning of the Code allegedly committed by the respondents.”
4The Applicant provided lengthy submissions in apparent response to the NOID; however, the applicant did not address these issues in a meaningful way. The applicant does make a number of inappropriate and unfounded allegations about the Tribunal’s neutrality and the submissions also contain a number of overtly homophobic and sexist remarks.
5At this preliminary stage before the Application has been delivered to the respondent and a Response (Form 2) has been filed, the Tribunal will only dismiss an Application where it is plain and obvious that it is outside the its jurisdiction. However, in my view, it is plain and obvious that the applicant’s complaints have no connection to the grounds of discrimination he has claimed.
6In his Application the applicant includes an extraordinarily lengthy narrative but it does not appear to contain any allegations that engage the Code. The narrative goes back and forth describing what may be events in the applicant’s childhood, which he connects to other events which may have occurred while the applicant was employed by Bell Canada in the late 1990s. The narrative is very hard to follow. What is important is that there do not appear to be any coherent allegations about the conduct of the identified respondents that remotely engage the Code. Below is an excerpt from the narrative that captures elements of the applicant’s belief that he has experienced discrimination:
Much of my complaint centers around these two incidents which have both happened within the last year, one in March of last year and one in April, but these two incidents themselves are a product of a lot of other factors and in the long run, they end up being a long running fued between myself and my father Don Richardson who was listed as a simple school teacher, but nothing about his school or his existence is simple> it's far more plausible that this case will deal entirely with psycology and the mafia then with the two cases I will sight as my human rights complaints. That's because I was born into the mafia to a parent who is at the head of if and used the school board to invent the SEE brand which is what I call SEE Ed> it teach how the mob is actually all the angry mob all around us and SEE EDucation is the seed that leads us to WE ED> the marrying of you wanna look as I would describe
As a consequence of not being a 'team player' and going along with the mob around me I've essentially been hazed much like a player on a hockey team> like Theoren Fluery formerly of the Calgary Flames who even took part and I have my own Theory on why Theoren might have wanted to take part in this big fat gay story. Unlike Theoren Fluery, most of the people that did this hazing to me were not invited in part to do so, but may have received pre-invitations, and the theme was Gay related sex being forced upon me against my will. At one point I was presented with a LORDS jacket, then months later was being followed hundreds of miles across the country by a woman from my own street in Calgary who wanted to be my new student teach for music at my new school> she also wanted to buy the jacket I've now come to know as the gay LORDS jacket off of me. In retrospect, I also put her down for one other significant thing where she gave me the sheet music in Calgary to STAR WARS which was cool at the time indeed, what kid wasn't a star wars fan right? Problem is, my father Don who is more than just a mafia Don and has the jail practically named after him from the river we used to dump shit in just to remind people that you might get the shit beat out of you, etc,etc, at the Don, that Don, my Dad, did tell me as a teenager that I would see one day that he was darth vader> darth vader who is the evil bad guy, but has the son that is the complete exact opposite, and this student teacher at ECI, Ms Kim Koon as it is, she gave me that sheet music maybe five, or six years prior when I was learning piano. …
7The Application is dismissed.
8The allegation as against the Daily Bread Food Bank and Beth Sorichetti appears to be that they failed to adequately deal with the applicant’s concerns about a fellow volunteer. The applicant alleges that this individual had sexually harassed and assaulted him 12 years previously. The applicant alleges that this person asked for his forgiveness but that the applicant did not trust him and feared this person. The applicant raised these concerns with the respondents and they offered to meet with him to discuss his concerns and seek ways to resolve them. The applicant declined to meet to discuss his concerns. He would not identify either himself or the other individual. The respondents advised that in the circumstances they could not ensure that he might not find himself volunteering at the same time as this individual. The applicant also appears to have wanted the Daily Bread Food Bank to validate his concerns in some way so that the next time he encountered this individual he would have some proof of the applicant’s allegations. The respondents assured the applicant that they were willing to discuss his concerns, but that if he chose not to do so, they assured him that supervisory staff would be present to assist if he felt threatened while volunteering in their workplace.
9The allegations against the Law Society of Upper Canada and Adele Dyrczon appear to relate to a complaint of poor or inadequate representation by a lawyer which the applicant filed in September 2011. The allegation appears to be that the respondents did not adequately deal with the complaint, although this is entirely unclear. The applicant appears to allege that that it took the respondents too long to investigate his complaint. The remaining allegations are difficult to understand. The following captures some of the central issues raised by the applicant as regards the Law Society’s investigation:
As mentioned the law society received my Jeffrebutal and figured Sk HATED it.
They acted unprofessional, ignoring the parts where a gay man is allowed to chase me around my office and it's not reflected in my case, and they ignore that police are permitted to kick my door down and just claim they were there to save me when a lie detector would them a new one and expose that we have a go fuck yourself police department that does what ever the fuck to whoever the fuck it want's.
The law society overlooks in my complaint the fact that I was after the fact taken to a place that ends up translating into weird experiments where they chase me around and insist on making consume rat poison and I mentioned to the lawyer that YASMIN is a drug many women have been allowed to sue the manufacturer over it's dangerousness to the end user yet mental patients are having it forced on them against their consent taken and given and administered to them under a different name, but it is the identical drug, I've checked. So why can't that mental patient that you've bullied into pleading guilty to charges at least twice and bullied thru a shameful sham of a court system that treats them lie vegetables sue for such degrading treatment?
Also while locked up at the mental hospital, my room mate threw my shoes in the garbage>you'll pay for that with your asses not to worry, we just hurt your future versions and incarnations of you, the garbage can keep my shoes> and I was forced to watch this sick man put up xxx hard core male on male pornography. A dick in the ass it is, hun. That's your idea of a hospital? Bend over then, my turn to show you stupid AN US teamey mcteamersons how it's done. An US you wanted to be, then anus it is! Fuck with me not, it hurt you for longer than you wish to know, but I'd grab for apology speeches soon you sick fuckin assholes, or my penetration shots will only hurt you that much more on the rebound reality would tell you their bound to too. We're just twaining you to mark the spot with an x Jimbo. Almost finished here
Finally you hucked rock after rock at me when I was a star and you were just jealous. You tried to pop every balloon I ever blew up with my own hard earned breath. You tried to take the wind literally right the fuck out of my sails. You actually took to much pleasure watching go back and forth between my apartment and mr. welmans offices. All the bozo's that would line up and meet me on the street that I knew from my past and hated, but stopped just to say so there so I could tell them about how I was in some lawsuit that I hoped would end much better. Every time I saw yet another goof from my past during one of those visits to my lawyers, I'd basically be thinking after the fact that they all had some inkling that the was gunna be shoved down a rat hole. They all came to enjoy watching me have my time wasted, and those were all the people that knew I wouldn't waste my time talking to them after the various list of rude things they'd done individually, but in that moment where I'm feeling proud about standing up for myself and going thru that process of suing people for having done something so physically and mentally abusive> it gave those undesirable people that I didn't' want to talk to anymore, it gave them one last opportunity to have a chance to at least approach me and see if I'd rub it in their nose that all the abuse had translated into a lawsuit. Most of them I didn't stop and give the time of day to, but now that they've all dried up and gone away, now I recognize why.
10As regards the Application as it relates to Sterling Karamar Property Management, the applicant’s landlord, the allegation may be that either because of the complaint to the Law Society of Upper Canada and/or the request made of The Daily Bread Food Bank, fire alarms were set off in his building or gay tenants were moved into his building.
11The applicant filed a narrative in excess of 250 pages; the brief selections set out above are exemplary of the substance of it. It is hard to follow and having reviewed it, it is entirely unclear what the precise basis of the applicant’s complaints are. Similarly, the applicant’s submissions in response to the NOID are lengthy and difficult to follow – at one point the applicant discusses at length the problem of ear wax. In any event the submissions do not shed any light on the nature of the Code complaint the applicant wishes to advance.
12I have reviewed the applicant’s materials. In total it exceeds 400 pages. It includes discussion of Kurt Cobain and Nirvana, drug use, and the applicant’s theory that the provincial government is a pimp and drug dealer. What the material does not describe or allude to except in the manner of bald assertion are any allegations of discrimination with the meaning of the Code. In particular in this Application, while the applicant appears to be unhappy with his treatment by the various respondents, there is nothing in the material filed that connects his complaints, the social areas claimed and the various grounds. In my view it is plain and obvious that the Application as currently framed raises no Code issues and accordingly it must be dismissed.
